The Construction Law Finland 2025 is a comprehensive summary of the legal aspects of construction projects and includes a separate chapter about trends and developments in the legal field and the operational environment.

“The Finnish construction market is gradually recovering from a long downswing. The obstacles related to lack of new housing starts, tighter financing conditions and rising material costs have not been completely overcome, but the market is also giving signs of cautious optimism for 2025 and beyond. Residential construction activities are still far below their peak, while other segments such as infrastructure and industrial facilities as well as public projects are still moving forward. The renovation market, especially for improving energy efficiency, is also expected to be strong. At the same time, sustainability and digitalisation continue to play a central role, reshaping the way construction projects are planned and delivered across Finland. In 2025, the adoption of technological advancements such as building information modelling (BIM), automation and AI in project management and design processes, as well as smart building technologies, is anticipated to increase significantly within the Finnish construction sector.

One significant ongoing reform is the revision of the general industry conditions in the construction sector, the YSE 1998 conditions. The renewal negotiations are being conducted by the industry associations Finnish Property Owners Rakli and the Confederation of Finnish Construction Industries RT (CFCI). The revision examines the effects of changes in the operating environment and the needs for change identified jointly by the parties. Negotiations address, inter alia, conditions related to change orders as well as conditions concerning co-operation between the parties. The local industry standard conditions are almost 30 years old, and although they have stood the test of time, there are several drivers that address the need for “YSE 1998 2.0”. One of the drivers is the fact that many stakeholders in the field, especially in more complex projects, already supplement or deviate from YSE 1998 conditions in the construction contracts to address more modern forms of risk-sharing. In addition, over the decades a vast Finnish case law has evolved around YSE conditions and many practitioners in the field believe that a new version could incorporate clarifications on the practices established by the courts”, describe Rosa Lång, Juho Lönnblad, Helena Kalmanlehto and Alisa Montonen.
